These Terms of Service govern all business transactions, service bookings, and contractual agreements conducted via www.followshoot.com, operated by followshoot (hereinafter referred to as “we”, “us”, or “our”), with customers residing in the European Union and the Federal Republic of Germany. By accessing our website, booking our services, or submitting a payment, you (the “Client”) agree to be bound by these terms.
2. Nature of Services & One-Time Transactions
We provide professional photography and visual documentation services.
- One-Time Purchase: All transactions conducted via www.followshoot.com represent strictly one-time purchases for specific, bespoke photography sessions or packages. There are no automatic renewals, recurring billing cycles, or subscription commitments associated with our services.
- Pricing & Quotations: Fees are established on a per-project or per-session basis following individual client consultation and quotation approval.
3. Payment Terms & Execution Flow
- Booking & Deposits: To secure a photography session date and time slot, a required deposit must be paid upon confirmation of the service quotation.
- Final Balance: The remaining balance for the one-time service must be fully settled upon completion of the photography session and prior to the final delivery of the edited visual assets.
- Payment Methods: All payments are processed securely through our designated payment infrastructure.
4. Cancellation, Rescheduling, and Refund Policy
- Rescheduling: Requests to reschedule a booked photography session must be submitted in writing within a reasonable timeframe prior to the scheduled date, subject to availability.
- Cancellations: Because our services involve reserved professional schedules and customized preparation, cancellations initiated by the client are subject to strict terms. Retainer deposits are non-refundable once administrative and logistical planning has commenced, in accordance with applicable German and European consumer protection frameworks for customized services.
5. Intellectual Property & Usage Rights
All original photographs, digital negatives, and visual materials produced by followshoot remain protected under applicable copyright laws. Upon full and final settlement of the one-time service fee, the client is granted a non-exclusive, non-transferable personal license to use the delivered images for private, non-commercial purposes, unless a separate commercial agreement has been explicitly executed in writing.
6. Limitation of Liability
To the maximum extent permitted by applicable German and European Union law, our liability for any direct contractual breach or negligence is strictly limited to the total monetary amount actually paid by the client for the specific one-time service in question. We assume no liability for indirect, incidental, or consequential losses arising from event delays, weather conditions, or unforeseen logistical disruptions beyond our reasonable control.
7. Governing Law and Jurisdiction
These Terms of Service and all legal relationships between the client and followshoot shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG), without prejudice to mandatory statutory consumer protection provisions under the laws of the client’s country of habitual residence within the European Union.
